Terms & Conditions of Attendance and Participation

 

These Terms & Conditions of Attendance and Participation (this “Agreement”) governs your attendance at and/or participation in a Dolce Glow LLC or Dolce Glow, Inc. (referred to herein as “Dolce Glow” or “us” or “we”) sponsored Event (referred to herein as an “Event”).  

 

By registering for the Event, you are agreeing to these terms, which form a legal contract between Dolce Glow and the registered attendee and/or participant (“you”). If you are registering on behalf of another, it is your responsibility to ensure that the person attending is aware of these terms and accepts them, and by completing the registration you are warranting that you have made the attendee aware of these terms and that they have accepted these terms.  

 

1. Event Admission

 

• Your registration entitles you to admittance to the Event. Any and all other costs associated with your attendance (including without limitation any travel and/or accommodation expenses) shall be borne solely by you, and we shall have no liability for such costs.  

 

• You acknowledge and agree that Dolce Glow, in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, hosts, moderators, venue and time.  

 

• By attending the Event, you acknowledge and agree to grant us the right to record, film, photograph or capture your likeness in any media now available and hereafter developed and to distribute, broadcast, use or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use and/or disseminate the media. 

 

• You acknowledge that Dolce Glow reserves the right to request your removal from the Event if Dolce Glow, in its sole discretion, considers your presence and/or behavior to create a disruption or to hinder the Event and/or the enjoyment of the Event by other attendees or speakers.  

 

• Each individual must have an individual registration, and badges, tickets, and other Event access items are not to be shared. Only one registration per person is allowed, and you must keep your registration information up to date.

 

• You agree to observe and follow all of the rules, policies, and procedures of the Event venue, including in relation to health and safety, as well as all reasonable instructions issued by us or the staff at the Event venue.

 

• You agree to behave in a respectful, peaceful, and appropriate way at the Event(s) that does not breach any applicable laws or regulations, or risk bringing the Event, Dolce Glow, or any Event attendees or guests into disrepute.

 

• You recognize and agree that it is your responsibility to ensure you have adequate insurance for your own requirements, including personal accident and travel insurance, prior to attending any Event. You also recognize and agree that your travel to and from any Event is at your own risk and we are not responsible for your health, safety, or any damages to you in connection therewith.

 

• Admission to the Event(s) is restricted to persons 16 years of age and over. Persons under 16 will not be permitted at any Event, unless otherwise allowed in our sole discretion.

 

• We reserve the right to decline registration of any applicant.

 

2. Fees; Substitutions

 

• The payment of the applicable fee(s) for the Event is due upon registration. If such payment is insufficient or declined for any reason, we may refuse to admit you to the Event and we shall have no liability in that regard.  

 

• The fee(s) may be subject sales tax, value added tax, or any other taxes and duties which, if applicable, will be charged to you in addition to our fee(s).

 

• All sales are final. No refunds or credits shall be issued for “no shows,” cancellations, substitutions, or for any other reason, including without limitation, interruption, postponement, cancellation, or relocation of the Event due to any cause determined by us to be beyond our reasonable control; provided, however, that substitutions (subject to availability) may be arranged in the sole discretion of Dolce Glow.

4. Intellectual Property  

 

All intellectual property rights in and to the Event, the Event content, and all materials distributed at or in connection with the Event, are owned by Dolce Glow and/or the Event speakers or companies presenting at the Event. You may not use or reproduce, or allow anyone to use or reproduce, any trademarks or other intellectual property (including without limitation the Event brand or other trade names appearing at the Event), any Event content and/or any materials distributed at or in connection with the Event for any reason without the prior written permission of Dolce Glow or the applicable holder of the intellectual property rights.  

 

5. Warranties and Limitation of Liability 

 

• Dolce Glow gives no warranties in respect of any aspect of the Event or any materials related thereto or offered at the Event and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness and merchantability. Neither Dolce Glow nor its affiliates accept any responsibility or liability for reliance by you or any person on any aspect of the Event and/or any information provided at the Event.

 

• Neither Dolce Glow nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with this Agreement.

 

• The maximum aggregate liability of Dolce Glow for any claim in any way connected with any Event or this Agreement, whether in contract, tort, or otherwise (including any negligent act or omission), shall be limited to the amount paid by you to Dolce Glow under this Agreement to attend the Event. 

 

6. Reservation of Rights

 

Dolce Glow reserves the right, in its sole and unfettered discretion to: (i) change or modify the layout of the Event and/or relocate the Event, sessions, exhibits or presenters; (ii) cancel, in whole or in part, the Event due to an event of force majeure; and (iii) change the date, location and duration of the Event, all without any liability to Dolce Glow. You agree to hold Dolce harmless from and against any and all costs, damages, and expenses, including attorney fees, which are incurred by you in connection with the foregoing. Dolce Glow may reschedule any cancelled Event in its sole discretion.

 

7. Force Majeure

 

In the event that (i) the facility or venue at which the Event is to be held or is held is destroyed or becomes unavailable for occupancy or (ii) Dolce Glow is unable to permit any attendees to occupy the facility or the space, or (iii) if the Event is cancelled or curtailed, for any reasons beyond the control of Dolce Glow, including but not limited to, casualty, explosion, fire, lightning, flood, weather, epidemic, pandemic, government mandates, earthquake or other Acts of God, acts of public enemies, riots or civil disturbances, strike, lockout or boycott, then Dolce Glow will not be responsible for any loss of business, loss of profits, consequential or special damages or expenses of whatever nature that you may suffer.

 

8. Consent

 

By choosing to consent to receiving CEMs (commercial electronic messages) regarding the Event, you give your express consent to receiving email, text, and or HTML communications from us regarding updates to the Event you registered for and other shows, conferences, or events we organize.  You may choose to unsubscribe at any time.

 

9. Governing Law and Jurisdiction

 

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to any applicable conflicts of law principles.  You irrevocably consent to the exclusive jurisdiction and venue of the federal and state courts of competent jurisdiction located in Los Angeles County, California, and you waive any objection that venue in such courts is inconvenient.
